1. Introduction
These Terms & Conditions ("Terms") govern your access to and use of Healthixio (the "Service"), a hospital management software solution. By creating an account, accessing, or using the Service, you (the "Customer" or "User") agree to these Terms.
If you are using the Service on behalf of a legal entity (e.g., hospital, clinic, diagnostic center), you represent that you have the authority to bind that entity, and "you" will refer to that entity.
This document is an electronic record in terms of the Information Technology Act, 2000 and the rules thereunder. It is generated by a computer system and does not require any physical or digital signature. This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
2. Definitions
- Account: A unique profile enabling use of the Service.
- Subscription: The paid plan(s) granting time-bound access to the Service and features.
- Customer Data: Any data, files, content, or information submitted to the Service by you.
- Documentation: Online guides, manuals, and FAQs provided by us.
3. Scope of Service & License
We grant you a non-exclusive, non-transferable, limited right to access and use the Service for your internal business operations, subject to these Terms and your active Subscription.
We may improve, modify, or discontinue features from time to time, with reasonable efforts to avoid material degradation of core functionality.
We may modify these Terms at any time without prior notice. It is your responsibility to periodically review these Terms to stay informed of updates. Continued use of the Service after changes are posted constitutes acceptance of those changes.
You agree to provide true, accurate and complete information when registering and using the Service and you remain responsible for all activity under your account.
4. Eligibility & Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must promptly notify us of any unauthorized access or security breach related to your Account.
5. Acceptable Use
Do not misuse the Service, including but not limited to: reverse engineering, attempting to access non-public areas, or interfering with system integrity. Use the Service only for lawful healthcare management purposes; do not use it for emergency medical responses or as a substitute for professional clinical judgment.
6. Fees, Billing & Taxes
Fees are charged in advance per the plan you select.
7. Refund PolicyNo Refunds
Important Notice:
We provide a 7-day free trial to evaluate the Service. All purchases are final and non-refundable once you choose to subscribe after the trial period.
Since ample time is provided to evaluate the Service during the trial, all purchases and subscription fees are final and non‑refundable. If you subscribe after the 7‑day trial, that subscription payment will not be refunded under any circumstances.
Cancellation and No‑Refunds Policy
- All purchases, including subscriptions, setup fees, and add‑ons, are non‑refundable.
- You may cancel your subscription at any time to prevent future recurring charges; cancellation does not entitle you to a refund for any charges already incurred.
- For orders of physical goods or one‑time services, cancellation requests may be accepted to stop future processing if the goods/services have not been shipped or initiated, but no refunds will be issued for amounts already paid.
- Where a product is received damaged or defective, please report the issue to our support team within 7 days; we will investigate and, at our discretion, provide remediation which may include replacement or remedial service. Remediation decisions are made on a case‑by‑case basis and do not imply an obligation to provide a monetary refund.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or business interruption.
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this Website or through the Services for any specific purpose. All content is provided "as is" unless otherwise stated.
You shall indemnify and hold harmless the Platform Owner, its affiliates, and their respective officers, directors, agents and employees from any claim, demand, loss or actions (including reasonable attorney's fees) arising out of your breach of these Terms, Privacy Policy or applicable law.
Notwithstanding anything contained in these Terms, neither party shall be liable for delay or failure to perform obligations caused by events beyond their reasonable control (force majeure).
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Gwalior, Madhya Pradesh, India.
